Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the SendQ platform, operated by Tamimah Digital LLC (“SendQ”, “we”, “our”, or “us”), a company registered in the Sultanate of Oman. Please read these Terms carefully before using our services.

1 Acceptance of Terms

By accessing or using SendQ, creating an account, or clicking “I agree,” you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our platform.

These Terms constitute a legally binding agreement between you and Tamimah Digital LLC.

2 Eligibility & Account Registration

To use SendQ, you must:

  • Be at least 18 years of age
  • Be capable of forming a binding contract under applicable law
  • Not be prohibited from receiving services under Omani law or any other applicable jurisdiction

When registering, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Important: Notify us immediately at [email protected] if you suspect unauthorized use of your account.

3 Permitted Use of the Platform

SendQ grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your internal business purposes, subject to these Terms.

Permitted uses include:

  • Creating and sending permission-based email marketing campaigns
  • Managing your subscriber lists and contact data
  • Using automation workflows to engage with your audience
  • Accessing analytics and reporting features
  • Integrating SendQ with your own systems via our API

4 Prohibited Activities

You agree NOT to use SendQ to:

  • Send unsolicited bulk emails (spam) or emails to purchased, rented, or scraped lists
  • Distribute malware, viruses, phishing content, or any malicious code
  • Promote illegal products or services, including under Omani law
  • Harvest or collect email addresses without proper consent
  • Impersonate any person or entity or misrepresent your identity
  • Attempt to reverse-engineer, decompile, or disassemble any part of our platform
  • Overload, damage, or impair SendQ’s servers or infrastructure
  • Violate any applicable laws, including data protection and anti-spam regulations
Violation of these terms may result in immediate account suspension or termination without refund. Severe violations may be reported to relevant authorities.

5 Subscription Plans & Billing

SendQ offers the following subscription plans, billed in Omani Rials (OMR):

  • Starter — OMR 9/month · 10,000 emails/month
  • Growth — OMR 39/month · 50,000 emails/month
  • Pro — OMR 89/month · 150,000 emails/month
  • Enterprise — OMR 179/month · 300,000+ emails/month

All plans include unlimited subscribers. Billing is charged at the start of each billing cycle. You may upgrade or downgrade your plan at any time.

Refund Policy: Payments are non-refundable except where required by law. If you cancel your subscription, you will retain access until the end of the current billing period.

Free Trial: New accounts may access a 7-day free trial. No credit card is required to start a trial. At the end of the trial, a subscription plan must be selected to continue using the platform.

6 Intellectual Property

All rights, title, and interest in and to the SendQ platform — including its software, design, trademarks, logos, and content — are and remain the exclusive property of Tamimah Digital LLC.

Your content (email campaigns, subscriber data, uploaded assets) remains your property. By using SendQ, you grant us a limited license to store and process your content solely to provide the service.

You may not use our logo, brand name, or trademarks without our prior written consent.

7 Disclaimer of Warranties

SendQ is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, or completely secure, although we commit to maintaining a 99.9% uptime SLA.

8 Limitation of Liability

To the maximum extent permitted by law, Tamimah Digital LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use SendQ.

Our total liability to you for any claim arising under these Terms shall not exceed the amount paid by you to SendQ in the three (3) months preceding the claim.

9 Termination

You may cancel your account at any time from your account settings or by contacting [email protected].

We reserve the right to suspend or terminate your account immediately and without notice if you:

  • Violate any provision of these Terms
  • Engage in fraudulent, abusive, or illegal conduct
  • Fail to pay applicable fees

Upon termination, your right to use the platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes, in accordance with our Privacy Policy.

10 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Sultanate of Oman. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Muscat, Oman.

11 Changes to Terms

We may revise these Terms at any time. When we do, we will update the “Last Updated” date and notify registered users by email at least 14 days before significant changes take effect. Your continued use of SendQ after changes become effective constitutes your acceptance of the revised Terms.
